Free WIFI Terms of Use – Park HaTachana

General

Free internet service (free Wi Fi – “The Service”) of Park Hatachana. Use of the service will be subject to the provisions of the law and these general terms. By clicking on the “I Agree” button at the bottom of the general terms, you agree and accept all of the terms specified below, including the full terms appearing on the Tel-Aviv Yafo Municipality website.

For your information, the service is provided a provider by Atarim in Tel-Aviv Yafo Coastline Development Company Ltd. (Hereinafter – “The Company”), which operates the park at its courtesy. The right to use the service is at the discretion of the Company and subject to the terms specified below.

Operation of the service, quality of service, method of operation and/or termination are in accordance with the law, and are subject to the commercia agreements between the Company and the provider. You will not be entitled to make any argument, demand and/or claim against the Company and/or the provider.

User Undertakings and Declarations

By using the service, you are undertaking to use the service in accordance with the law, and subject to the operating instructions and guidelines to be issued by the Company and/or the provider from time to time. Without derogating from the generality of the specified above, you hereby declare that you will not use the service to perform the following actions:

Unlawful hacking of a computer or to send a virus; disruption or interference of other computers, eavesdropping on communication between computers; infringement of intellectual property rights of other organizations / users online including copyright infringement / use of trademarks, etc.; sending email to users in a manner that creates a nuisance and/or triggers complaints from recipients of the messages (spamming), or violation of the standard code of conduct on the internet. You are hereby declaring that you are solely liable for the results of use prohibited by law, and accordingly, you undertake to indemnify the Company and/or the Provider for any damage and/or expense (including legal expenses) to be incurred by them and/or by a third party as a result of use I will make of the service, including for damages and/or losses and/or expenses incurred as a result to a violation of any of the provisions of the terms of this document, or as a result of any action in violation of the other laws that were sent to me.

Limit of liability

The service can be used As Is. The user will have no allegation, claim or demand against the Company and/or the Provider for the service’s properties, ability, limitations, adaptation to the user’s needs or expectations. The width of the band allotted for use does not guarantee certain browsing speed on the Internet; browsing speed is affected by the width of the band acquired and by other factors.

It is hereby clarified that the Provider performs, directly or indirectly, management and control of the internet in order to guarantee the normal provision of services to all internet subscribers, and these actions may affect internet browsing speed. The Company and the Provider may change from time to time the scope and availability of service, and any technical aspect related therein. Said changes will be made, inter alia, taking into account the quality of service, the dynamic nature of the internet, continual advancements in computers, on changes in computer software and applications provided by the service.

The service provided by the Company and Provider depend on third parties (Bezeq, cable, information providers, various service providers, etc.). It is hereby clarified that the Company and the Provider are not liable for any act or omission of these third parties and will not bear any damages / loss / expense to be incurred as a result, including as a result of installation by third party, line activity, third party rates and quality of their service. The Park and the Provider are not liable for damages related to Bezeq, cable, internet, equipment or systems that use the environment of the user’s applications, modem card installed in the user or any other equipment.

It is hereby clarified that the Company and Provider are not liable for information security, for securing data transferred as part of the service and/or for any resulting damage / loss / expense, either directly or indirectly, including as a result of hacking of unauthorized persons into the user’s systems and equipment.

It is hereby clarified that the service by nature is subject to disconnections and/or disruptions, and the Company and the Provider do not undertake to provide the service continuously and without any disconnections and/or disruptions.

The Company and the Provider do not undertake to the content, form, reliability and accuracy of data received by the user, as well as the security of information and data sent as part of the service provision, and/or any damage / loss / expense to be incurred as a result by the user, including as a result of hacking by unauthorized persons into the user’s systems and equipment.

The user will have no argument, claim and/or demand against the Company and the Provider for any damage, loss, payment, expense or loss of profit that they will incur as a result of use of the service, and the Company and/or Provider will not bear any liability for any damage, including indirect, consequential or non- monetary damage to be caused, if any is caused, to the user, as part of the provision of service, and/or as a result of termination of service for any reason. It is hereby clarified that the Company and the Provider are not liable for securing information and its content.

The user knows that the Company and the Provider are unable to supervise, screen and/or control the content, sites, and activities performed on the internet, including forums, chats, links, use of services, entry to sites and software downloads. Use of a range of options as specified will be the responsibility of the user alone.

It is hereby agreed that in all matters relating to the provision of the services by the Company and the Provider, the immunity provided for in Sections 41-40 of the Communications (Bezeq and Broadcasting) Law, 5742-1982, will apply to them.

Downtime and/or restrictions of service

The Company is entitled to perform, at its discretion, scheduled and/or unscheduled downtime and/or restrictions on services, inter alia, to perform improvements, changes, tests, maintenance, resource management, etc. To remove any and all doubt, these actions will not be considered a malfunction, and the user will have not claim with regards to these.

Jurisdiction and applicability of laws

It is hereby agreed that the courts in Tel-Aviv will have sole jurisdiction with regards to this Agreement and anything derived thereof. This Agreement is subject to the laws of the State of Israel and will be interpreted by them alone, and this despite the specified in the law.
